Below are the details of the cValue Sports Inc. User Agreement.
It clearly defines the manner in which cValue Sports Inc.
serves the public.
The details of this User Agreement
apply to cValue Sports Inc., and any related companies,
and subsidiaries. Only those individuals that agree to
our User Agreement and all of its terms are able to benefit
from our services. A confirmed registration on our site
is dependant upon the individual's acceptance of
this User Agreement.
CValue Sports Inc. reserves the right to edit this agreement
and any of its terms whenever deemed necessary. Any revisions
will be publicly aired on our site and will become effective
30 days thereafter.
1. Membership:
An eligible member must agree to
all terms and conditions set forth herewith and in our
Privacy Policy. Both
policies must be accepted in order to process the membership
request. The individual must be able to properly complete
a registration form and agree to all of its terms and
conditions. Once a registration is approved the individual's
User Name, ID and Password are deemed to be private property
and are not allowed to be sold or rented at any time.
2. Subscription Fees:
There are three different subscription levels currently
offered by cValue Sports Inc. Please refer to our Subscription
Rates for further details. There are fees for joining our
site, and using any of its available services. cValue Sports
Inc. has the right to change any or all of its fee structures
at any time. All members will be directly contacted should
this ever occur. All fees are listed in U.S. funds. The
individual member is solely responsible for paying all
necessary taxes.
3. Terms and Payments:
A. Initial Subscription:
By subscribing to one of our subscription levels, you automatically
agree to have your credit card charged for the cost of
that type of subscription.
B. Automatic Subscription Renewal:
Your one-month and annual subscriptions will be automatically
renewed unless you notify us in writing 14-days prior to
its expiration date. All other subscriptions (the daily
subscription) will expire unless you notify us otherwise.
If your subscription is automatically renewed, your membership
will continue at the same level as it did previously. At
the time of the automatic renewal, your credit card will
be charged at the current subscription rate.
C. Your Billing Date:
Your credit card will be automatically charged for your
subscription renewal on the anniversary of the expiration
of your previous membership.
D. Refunds:
There are no refunds. All of cValue Sports Inc. fees and
charges are nonrefundable.
E. Payment Methods
All payments to cValue Sports Inc. must be made by VISA,
MasterCard, or Paypal. cValue Sports Inc. uses only the
most reputable of payment processing services.
F. Taxes:
You are responsible for paying any government taxes imposed
on you by either the Federal, Provincial or State governments.
4. Your
Account Information:
You are responsible for keeping your account information
up-to-date. We expect that your credit card information
is updated when necessary.
5. cValue
Sports Inc.
A. Our main goal is to provide
the common sports memorabilia collector with information.
The information is to be of a historical and at the same
time current nature. cValue Sports Inc. does not claim
to be an expert on determining an item's value.
It is not our goal to evaluate a piece of memorabilia.
Our main objective is to enlighten the sports collector
and report on any recent news, for example, upcoming
auctions, shows, market trends, etc. Our sources for
values include auction results, dealers, and collector
contributors.
B. cValue Sports Inc. believes
that the hobby and passion of collecting is more fun
when it can be shared by those who truly appreciate it.
Cvalue Sports Inc. is comprised of a group of avid collectors
that enjoy sharing their love of collecting with each
other. Therefore, we
offer several services in the hopes of connecting sports
collectors worldwide: chat room, buying and selling opportunities,
pro's corner, etc. Catering to the needs of the sports
collectors and keeping them well informed is cValue's
mission.
C. We rely on the honesty of our
members and trust that all personal data that they register
with us is factual. Therefore, we do not involve ourselves
with the actual purchase or sale of an item. All we do
is help our members list memorabilia for sale and hope
that the payment and shipping processes are carried out
in an orderly and timely fashion. In the case that a
valid complaint is registered to cValue Sports Inc.,
we reserve the right to terminate a member's subscription
immediately.
D. Should a disagreement arise between members, cValue
Sports Inc. (its owners, officers, and employees) cannot
be held responsible in any way.
E. Since we do rely on a
system of trust between ourselves and our members, cValue
Sports Inc. cannot in any way be responsible for or control
the personal information that a member provides. We urge
all of our members to be careful with any personal information
that they wish to share with others.
6. Buying
and Selling:
All buyers and sellers are personally responsible for
ensuring that the transaction in question is carried out
in a legal manner. cValue Sports Inc. is not responsible
in any way for the outcome of any sale.
The seller is obligated to clearly indicate the condition,
age, selling price and any additional hidden costs that
may arise at the end of a transaction.
Should fraud be proven in any transaction the memberships
of the individual party or parties deemed responsible
will be immediately terminated by cValue Sports Inc.
The buyer is responsible for contacting the vendor
and providing any personal data necessary, including
credit information, to help in completing the sale. cValue
Sports Inc. cannot be held responsible in any way for
any errors concerning sales.
7. Member's
Information:
‘Member's Information' refers
to all personal data provided by the subscriber to cValue
Sports Inc. It is the individual member that is completely
responsible for maintaining that his/her personal data
is factual, accurate, and kept up-to-date.
8. Permitted
Access:
As a member of cValue Sports Inc.
you agree: 1) not to use any of the site's written
or graphic information, 2) not to use any technological
means by which to extract any of our servers, and 3)
all cValue Sports Inc. images are coded.
9. Violation
of our Terms:
As a last resort, should
cValue Sports Inc. be able to prove that a member has
breached our Privacy Policy, User
Agreement or any of
our other terms and conditions,
that individual's membership will be immediately
terminated.
10. Our
Promise of Privacy:
cValue Sports Inc. promises never
to sell, rent, or supply any member's personal
information without written consent directly from the
individual subscriber.
11. Liability:
Clearly,
and under no circumstances can cValue Sports Inc. or
any of its
directors, officers, or employees be held accountable
or liable for any personal
losses, financial or otherwise, or damages resulting
from use of our services.
12. Security:
As a member of cValue Sports
Inc. you agree to indemnify us (our directors, officers
and employees of any of our companies and subsidiaries)
and hold us faultless from
any legal claims or demands that may arise.
13. Legal
Fulfillment:
cValue
Sports Inc. expects all of its subscribers to obey all
relevant laws (regional, domestic
and international) at all times.
14. Affiliation:
As a
member of cValue Sports Inc. you are considered to be an
independent party and
in no way related to the organization, its subsidiaries,
directors, officers, or employees.
cValue Sports Inc and all of its subscribers will remain
at all times independent
of one another.
15. General
Details:
cValue
Sports Inc. and all of its terms, conditions, rules and
regulations shall be governed
by the laws of the Province of Quebec and further by the
Dominion of Canada.
cValue
Sports Inc. recognizes the fact that today's modern
technology is not at all times
faultless and there cannot guarantee constant uninterrupted
service. There may
be times when service is temporarily halted. Our
web site is hosted by one of the
leading servers in North America. Please understand that
any glitches in the otherwise
perfect service that cValue Sports Inc. strives for is
out of
our control.
Our ‘Forums' service
may not, at any time, be used as a personal forum or
for the purpose
of locating or harassing any other individuals. The sole
purpose of this service
is to enable collectors the opportunity to share relevant
information and expand
their knowledge in their own fields of interest.
16. Amendments:
